Permanent Residence

Permanent Residence Visa is a kind of an immigration visa/permit that enables the holders to stay in a foreign country for an indefinite period. A key characteristic of the visa is that even post the expiry of the initial visa, the holder has a right to remain inside the country, minus violating any immigration rules or regulations. In addition, the holders of Permanent Residence Visa can are eligible to apply for Citizenship in that country, subject to fulfillment of certain conditions. Holder of permanent residency visas may remain in that country indefinitely. A 5-year initial visa, which corresponds to the underlying migration scheme, is granted alongside the permanent residency. Until the initial visa expires, the visa holder may leave and re-enter the country freely. A notable feature of the permanent residency visa is that, even after the initial visa expires, the holder is entitled to stay in that country indefinitely without breaching immigration regulations.

The definition of "permanent resident" is different for immigration and citizenship purposes.

For the purpose of the Migration Act, a permanent resident is defined as:

  • A person who is the holder of a permanent visa; and
  • Is usually resident in that country (This normally means living in that country).
  • The "usually resident" requirement does not apply to applicants for a Resident Return Visa.
  • For citizenship purposes, "permanent residence" is defined as any period physically in that country as the holder of a permanent visa.
